Intro

The Association of REALbasic Professionals (hereafter referred to as 'ARBP') provides this web site and related services to any user (hereafter referred to as 'User') subject to the following terms and conditions. USE OF THIS SITE IMPLIES AN AGREEMENT TO ABIDE BY AND BE BOUND BY THESE TERMS, so please read the following information carefully.

Definitions

Site: the web site as referenced by http://www.arbp.org, http://www.arbpmembers.org, and any of their alias domains.

Content: All submissions made by user to the site...whether code, articles, comments, files, pictures, etc.

Content Submissions

User may choose to submit content to the site. User grants all other site users, including ARBP, the right to freely view all submitted content as well as use all content in their own programs without restriction, as well as grant the right to distribute compiled versions of code content freely and without restriction.

User understands that even after submitting content, they STILL RETAIN OWNERSHIP OF ANY COPYRIGHT OF THE CONTENT.However, the user does grant to ARBP a nonexclusive, worldwide license to link to, reproduce, distribute, adapt, perform, display, license and sublicense the submitted code or content.

User asserts that he or she owns the complete copyright to all content submitted to the site or is empowered by the original copyright holder to grant other parties the full rights detailed in this agreement. User further attests that no submitted content is subject to any license (such as the GPL Open Source License) that would infringe on any of the rights granted to other parties in this contract.

User agrees that the burden of determining proper copyright ownership of all their posted content, lies exclusively with themselves. User agrees to assume full liability for any disputes regarding ownership, copyright, or trademarks of any content they have submitted to this site and further agrees to hold ARBP complete harmless in all such regards.

ARBP reserves the right to refuse to post, alter, or remove any content at its sole discretion.

User Conduct

All accounts must be made with the user's legal first and last name, working email, and current postal mail address.

While using this site, you agree not to:

• Restrict or inhibit any other user from using the site. 

• Post any unlawful, fraudulent, threatening, abusive, defamatory, obscene or otherwise objectionable content.

• Post or transmit any information or software that contains a virus or other harmful/disruptive component.

• Post or transmit materials in violation of another party's copyright or intellectual property rights.

ARBP reserves the right to block or refuse access (or service) to any user who does not adhere to any the guidelines in these terms and conditions, without prior notice. ARBP also reserves the right to revoke access rights to any user at any time, at its sole discretion and without advance notice.

Transmission of Information and Communication

At purchase of the Software and at other times during the term of this EULA You will be required to supply certain information including, but not limited to, email address(es), password(s), personal and/or company information, payment information (e.g. credit card information), and/or other personally identifiable and potentially valuable information. Acceptance of this Agreement indicates your willingness to provide this information and have it transmitted to ARBP via internet, phone, facsimile, verbally, or otherwise and your assumption of the incumbent risks associated with such transfers. ARBP takes the privacy and security of data very seriously and will make efforts to protect data in accordance with this EULA. In any event, ARBP and its suppliers, licensors, successors, affiliates, agents, employees, executives, and assigns shall not be liable for any stolen, misdirected, or otherwise mishandled information pursuant to this EULA.

From time to time ARBP may contact you at any address, including any email address(es), you have provided to ARBP regarding ARBP or for promotional purposes. You hereby expressly consent to such communications. Your purchase of your membership and use of the organization indicates your acceptance of this communication and your assumption of the incumbent risks association with such communication.

Copyright Information

All pages and graphics on this this Internet site are the property of ARBP. The pages may not be redistributed or reproduced in any way, shape, or form without the written permission of ARBP.

User may link to any of the pages in the site. However, linking may not be done when encased in a frame, without express written permission of ARBP

User agrees NOT TO REDISTRIBUTE ANY SOURCE CODE ON THIS SITE (for example, but not limited to, reposting source code on another web site) without express written permission from all original copyright holders. Failure to do so is a violation not only of this agreement but of copyright laws.

Warranties

All content as well as the site itself are provided by ARBP 'as is', without warranties as to performance, fitness, merchantability, or any other warranty (whether expressed or implied).

There are no guarantees that the site will be available at any given time, and no guarantees that use of the site will not be subject to interruptions. All direct or indirect risk related to use of the site is borne entirely by the user.

The possibility exists that the site and its contents may contain inaccuracies or errors. ARBP makes no guarantees regarding the accuracy of the site or its contents.

The site contains links to other sites operated by third parties. ARBP does not endorse and is not affiliated with these linked sites, and is not responsible for any content that appears on these linked sites.

If you are located in the United States this agreement is subject to the laws of the state of Kansas. If you are located outside the United States local law may apply. Some states do not allow the exclusion of warranties, so the above exclusion may not apply to you.

Returns

We have made available as much information as posible about all of our products with all necessary documentation and support, and we strongly encourage all users to take advantage of them to make sure that they meet individual use and performance requirements prior to purchasing. We do our best to make sure our customers have the best, bug-free experience as is reasonably possible and want them to make the most informed decision as they can before they purchase a membership. But, ultimately, the customer is responsible for making sure the software will work in their environment. If you're not totally satisfied with your membership, please contact us within 30 days of your purchase date for a full refund and your account will be promptly closed.

Chargebacks to credit cards or stop payments on checks as a means to "return" a membership will be construed as fraud and prosecuted to the fullest extent of the law. Additionally, non-payment of duly issued invoices based upon a customer purchase order will be collected upon using all means possible. If you wish to return your order, please contact ARBP through our site BEFORE calling your credit card company.

By submitting your order to ARBP you agree to the above return policy.

Communications

Any information (including but not limited to bug fixes, suggestions, ideas) submitted to ARBP by any method (including but not limited to a contact page on any website, email, postal service, telephone, or other means) immediately becomes the property of ARBP. All communications are confidential but ARBP reserves the right to distribute any communication at their discretion. Submission of any information is not a binding agreement and does not obligate ARBP to implement the work suggested at any time. If a bug fix, suggestion, or idea is implemented either exactly as given or as a derivative work that is either sold or given away, any compensation or credit given to the sender is solely at the discretion of ARBP.

Indemnification

User agrees to indemnify and hold ARBP harmless from any dispute which may arise from a breach of terms of this Agreement. User further agrees to hold ARBP harmless from any claims and expenses, including reasonable attorney's fees and court costs, related to Customer's violation of this Agreement.

Trademark Information

The names ARBP and Association of REALbasic Professionals are registered trademarks and cannot be used without the written permission of ARBP. All other trademarks are the property of their respective owners.
